Money you send to the London company stops being yours. Clause 17.1 transfers absolute title to 4T, so your deposit becomes its property and you keep no interest in it. Client money protection applies only if 4T writes to you and says so.
Why this matters
You are left with a promise to be repaid, not a claim on your own cash. If 4T fails, that money is not ring-fenced for you. 4T's own clause says you lose the protections you would otherwise have.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Rarely seenHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.
the absolute title of the money is transferred to us for the purpose of securing or otherwise covering your present, future, actual or contingent or prospective obligations to us (Title Transfer Funds).
Firms licensed by the FCA cannot take absolute title to a retail client's money. The arrangement is open only to firms dealing with professional clients and eligible counterparties, which is how clause 3.1 classifies you.
4T is not licensed by this regulator, so this is a comparison of practice, not a finding of any breach.
Our readingOur own comment on the clause, not the broker's words. Anything we quote is marked as a quotation.A title transfer arrangement is a wholesale device used between institutions. Pointed at an individual, it turns a deposit into an unsecured loan to the broker.
- Worse together with Exhibit 3Read these two clauses together. Each one costs more because the other exists. The classification clause is what makes the title transfer available, so the two work only together.
- Limited by Exhibit 21Another clause softens this one. Read both before you judge it.4T Markets Limited is an FCA firm in the compensation scheme, and its contract says the FCA Rules beat the contract.
