What Brisk Markets legally published, but does not want you to read

Brisk Markets LLC publishes two different contracts under one name, and they disagree on the numbers. The live one lets it hold every dollar in your account while it investigates you. It can also bill its own trading costs to your balance. Its Safety of Funds page promises you cannot lose more than you deposit, and the contract says the opposite in three places.

What the documents say

19 clauses worth knowing about, worst first, each quoted from Brisk Markets's own files

01

Brisk Markets tells you on its Safety of Funds page that you never lose more than you deposit with it. The contract says the opposite. Clause 1.4 has you agree that a negative account will not change your life style.

In plain words

Negative balance protection is a limit that stops you owing more than you put in. Without it, one fast market move can leave you owing the broker money on top of your deposit.

Why this matters

If your losses run past your balance, nothing in this contract stops Brisk Markets asking you for the difference. Clause 4.4 says the money you deposited is no limit on what you can owe it.

Exhibit 1CriticalHarder than usual

You represent, warrant and agree that you understand the aforementioned risks and that you are willing and able, financially and otherwise, to assume the risks of trading in leveraged products and that the loss of your account balance and any resulting negative account will not change your life style.

Where it sits: section 4 of 30 in the Terms and Conditions, near the start.

Set against a regulated standard: FCA (UK), CySEC (Cyprus), ESMA (EU)

Firms licensed by the FCA and by CySEC must give retail clients negative balance protection, so a retail trading account cannot be pushed below zero. This contract states the opposite in clause 1.4 and clause 4.4.

Brisk Markets is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

02

Brisk Markets can close your positions, suspend your account and hold every dollar in it until an investigation it runs is finished. The live contract sets no deadline for that investigation and names nobody who reviews the decision.

Why this matters

Your money can sit frozen for as long as Brisk Markets takes. The contract gives you no date by which it must pay you, and no one to appeal to.

Exhibit 2CriticalHarder than usual

Brisk Markets reserves the right to close all positions, suspend the account, and withhold all funds until a full investigation is completed.

  • Worse together with Exhibit 3One clause cancels the trades and the other holds the balance, so a disputed profit and the money beside it are out of reach at once.
03

Brisk Markets can cancel your trades with no warning if it decides you used an Abusive Trading Strategy. Clause 11.2 lets it do that even when cancelling puts your account into loss. It also stops your withdrawals until it is satisfied.

Why this matters

The contract never defines which strategies count, so Brisk Markets decides after your trades have made money. Profit it cancels is gone, and clause 11.3 says it owes you nothing for acting.

Exhibit 3CriticalHarder than usual

Given the grave nature of Abusive Trading Strategies, you agree that we may, at our sole and absolute discretion, revoke Transactions resulting from Abusive Trading Strategies without prior notice to you and regardless of whether such revocation would result in Losses in your Account or would cause you to breach your Margin Requirements.

04

The live contract lets Brisk Markets recover its operational losses and its liquidity provider fees from your account balance. No amount is fixed, no cap is set, and no fee page on the site mentions it.

In plain words

Liquidity providers are outside banks and brokers.

Why this matters

A charge with no ceiling can reach whatever Brisk Markets says its costs were. The same section puts every deposit and withdrawal cost on you, while the homepage advertises funding as free.

Set against a regulated standard: FCA (UK), CySEC (Cyprus)

Firms licensed by the FCA and by CySEC must disclose costs and charges to a retail client before that client trades. This contract lets the charge be worked out afterwards, from the firm's own costs.

Brisk Markets is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

Our readingA retail trading contract normally states its charges as fixed amounts or percentages. This one lets the firm pass its own execution costs and losses to a client account without naming a figure.

05

The Terms and Conditions PDF in every page footer and the Trading Terms page in the menu are not the same contract. They give different stop out levels, which is the margin level where Brisk Markets closes your positions. The PDF says 20%. The live page says 60%.

Why this matters

At 60% Brisk Markets closes your trades much sooner than the PDF you were pointed to says it will. The live page also carries powers the PDF never mentions, including holding your funds and billing you for its costs.

Exhibit 4WarningRarely seen60%

therefore, the company set a stop out level at 20%, once that level is reached, an auto close will applied on opened positions in order to release a used margin to increase the margin level to maintain a portion of capital

Our readingBrokers publish one client agreement. Brisk Markets publishes two under the same name, and the numbers in them differ, so which set of rules governs your account is not settled by the documents themselves.

The 50% bonus page promises up to $500 on your first deposit, in English and in Arabic. The promotion terms cap the same bonus at $250. Their own example shows a $1,000 deposit earning $250.

Why this matters

Deposit $1,000 expecting $500 and you get half of that. The figure that binds Brisk Markets is the one in the terms, not the one on the page that asked you to deposit.

Every dollar can be held while Brisk Markets investigates

The live Brisk Markets contract lets the firm close your positions, suspend your account and withhold all funds until its own investigation finishes. No deadline is set for that investigation. Money paid in by card can only go back to the card, and clause 7.3(c) asks you to give up your chargeback rights.

Getting money out1 clause flagged

Money you pay in by card can only go back to that card. The same clause then says Brisk Markets will only accept requests to withdraw profits. Clause 7.3(c) has you give up the right to ask your card issuer for a chargeback.

Why this matters

A chargeback is the one route to your money that does not depend on Brisk Markets agreeing. Clause 7.3(c) asks you to sign it away whatever happens to your account.

Exhibit 8CriticalHarder than usual

You agree and undertake not to enter into or initiate any chargeback transaction with your Card issuer and irrevocably and unconditionally forfeit any future claims to make such chargeback regardless of the Losses incurred in your Account, or your overall satisfaction with the services provided to you in relation to your trading activities.

Profit can be cancelled on a judgement Brisk Markets makes alone

Clause 11.2 lets Brisk Markets revoke your trades at its sole and absolute discretion, with no warning, and hold your withdrawals until it is satisfied. The term that triggers it, Abusive Trading Strategy, is never defined. Its promotion terms go further and void profits across accounts it decides are related, including those of family members.

Keeping what you made1 clause flagged

Brisk Markets can treat accounts as related on a shared IP address, a shared device, a shared payment method, family members or household members. Where it then finds abuse, it can void the profits and close the accounts.

Why this matters

Two people in one home who both trade here can be linked without doing anything wrong. The terms let Brisk Markets decide the link on any combination of factors it chooses.

Exhibit 13CriticalHarder than usual

Charges the fee pages never mention

The live Brisk Markets contract lets the firm recover its own operational losses and liquidity provider fees from your account balance, with no cap and no published figure. Clause 16.4 charges you under a Schedule of Fees that Brisk Markets does not publish. The swap free Islamic account costs $50 a lot to hold gold past five days.

Cost disclosure2 clauses flagged

Clause 16.4 charges your account under a Schedule of Fees. No such schedule appears anywhere on the Brisk Markets site. Clause 7.1 also lets it apply fees on any basis it determines from time to time.

Why this matters

You cannot check a charge against a list that is not published. The contract lets Brisk Markets set the basis of its fees later, once your money is already with it.

The Islamic account is sold as having no swaps and no rollovers. Holding gold past five days costs $50 a lot in admin fees, charged by how many days the position stays open.

The plain-language parts, what a clause means for a client, how ordinary it is, and how it reads against a regulated standard, are WIKILIX's analysis and are labelled as such on every card. This is a reading of public documents, not legal advice and not an allegation of wrongdoing.

In fairness, and what we could not check

A reader who knows the edges of the work can trust the middle of it

No dormancy fee, no inactivity fee and no account maintenance charge appears anywhere in these documents, which is rarer than it should be. Brisk Markets publishes a typical spread and a swap rate for every instrument it offers, in full tables, plus the Islamic admin fee per lot. The deposits page gives a minimum, a commission and a processing time for each payment method. The bonus terms work the margin arithmetic through with the broker's own example, so you can see what the credit does before you take it.

We read the Terms and Conditions PDF, the privacy policy and the cookie policy in full, along with 36 of Brisk Markets' own pages. We read the Trading Terms page in parts, and every quotation credited to it comes from the parts we read. The Risk Disclosure Notice the footer points to is not there, so nobody has read it. The Funded Terms page in the site's own menu is not there either. The client area and the two account opening buttons gave us nothing to read, so we did not see the terms a client is shown at sign up. Brisk Markets runs its copy trading from a separate address we could not open, and it publishes no copy trading terms elsewhere. No earlier version of these documents is available, so this is a first reading with nothing to compare against.

How to check any of this yourself

Every quote above links to the Brisk Markets file it came from. This is what to do with it.

Open the three stepsFind the words in the source, work out the fingerprint, and read what a difference does and does not prove.

Open the source and search for the words

Every quote has a link under it. Open the file, or the web page, and search it for the words we quote. The clause number next to the quote tells you where to look.

If the words are not there any more, the source may have changed after we read it. That is worth knowing too. We keep the date we read it, and a code worked out from its wording, so the quote stays checkable.

What a fingerprint is

A fingerprint is a code worked out from what a source says. Change one word and the code changes completely. We keep two codes for every file we read, and the panel on each source shows both.

The first is the code of the exact file we downloaded. The second is the code of its wording alone, with capital letters lowered and runs of spaces collapsed. When the same words are saved as a new file, the first code changes and the second one stays the same.

Only the first code can be worked out on your own computer. Save the file, then run one of these, putting the name of the file you saved where the example is. The panel on each source prints the command with that source's real file name already in it.

macOS or Linux:
  shasum -a 256 the-file-you-saved.pdf

Windows:
  certutil -hashfile the-file-you-saved.pdf SHA256

The two codes are different from each other, and they are not meant to match. Comparing one against the other proves nothing.

What a difference means, and what it does not

A different file code on its own proves nothing. A PDF saved again with a new date inside it is a new file saying exactly the same thing.

A different wording code means the words themselves changed. That is the one that matters, and it is why we keep it.

Even then, a change is not proof of bad faith. Companies update their documents. What this report says is what the document said on the day we read it, and every quote carries that date.

A source that is a web page and not a file has no file to save, so only the code of its wording is shown.

How this report is made

Every clause quoted above comes from a document Brisk Markets publishes on its own website, downloaded and hashed on the date shown, with the clause number and page recorded so any reader can check it. We do not allege anything the documents do not say, and we do not judge Brisk Markets on anything other than its own published terms and its own public marketing. Where a clause has a qualifier that softens it, the report says so. Last read Sep 17, 2026.

If you represent Brisk Markets and a clause has changed, been withdrawn, or is being read out of context, tell us and we will re-read the documents and update this page. Corrections from the broker are welcome and are published with the reading they change. Contact us.

This is a reading of a contract, not legal advice and not a ruling on Brisk Markets. Whether its licence is real and current is a separate check on the broker profile.
