CG Invest defines illicit profit to include any profit you make during what it calls abnormal market conditions. Its own definition of those conditions is low liquidity, rapid price movements or price gaps. Nothing has to be wrong with your trading.
Why this matters
News releases and price gaps are exactly when a profitable trade pays. If CG Invest treats that profit as illicit, the default clause lets it adjust your balance and take the money back.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Rarely seenHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.
“Illicit Profit” shall mean profit which has been generated as a result of an Event of Default and/or during Abnormal Market Conditions.
Our readingOur own comment on the clause, not the broker's words. Anything we quote is marked as a quotation. Most client agreements tie profit removal to conduct: proven abuse, manipulation or arbitrage against the firm's prices. Here the trigger is a market condition, not anything the client did. The definition joins the two with and/or, so a market condition alone is enough.
- Worse together with Exhibit 2Read these two clauses together. Each one costs more because the other exists. One clause removes profit by definition, the other removes it by accusation, and both leave your losing trades standing.
- Worse together with Exhibit 14Read these two clauses together. Each one costs more because the other exists.Around a news release CG Invest cuts the leverage on positions you already hold, and any profit you do make in that window meets its definition of illicit profit.
