GIFX publishes two legal documents, a Disclaimer and a Privacy Policy. Neither is a contract. Its Disclaimer says every quote and every trade you make runs on the Client Agreement, the Perjanjian Nasabah. That document is not on the site.
Why this matters
You cannot read the withdrawal rules, the fees or the complaint deadline before you deposit, because GIFX does not publish them. Its Privacy Policy still holds you to the rules it imposes.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Rarely seenHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.2The figure this clause puts a number on, taken from the broker's own words.
Semua kuotasi dan transaksi selalu berdasarkan Syarat dan Kondisi dari Perjanjian Nasabah yang dapat diakses melalui situs ini.
Firms licensed by the FCA or CySEC must give a retail client the terms of business in writing before that client trades. GIFX names a Client Agreement in its Disclaimer and does not publish one.
GIFX is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.
Our readingOur own comment on the clause, not the broker's words. Anything we quote is marked as a quotation.A broker naming its own client agreement as the thing that governs every quote and transaction, then publishing no copy of it, is unusual. The mechanism leaves the binding terms entirely in the firm's hands: they can say anything, change at any time, and a client has no version to hold up against them.
- Worse together with Exhibit 3Read these two clauses together. Each one costs more because the other exists. With no contract published and no liability accepted, there is nothing written down that GIFX can be held to.
- Worse together with Exhibit 6Read these two clauses together. Each one costs more because the other exists. An unpublished contract and no named court leave you with neither the terms nor the forum to argue them in.
