Nothing Hankotrade publishes governs your trading account. Its Terms of Use covers use of the website, and calls itself part of a public documents package that the site never publishes.
Why this matters
If Hankotrade holds on to your money, no document tells you which law applies, which court hears it, or which company you contracted with. You would be arguing from four web pages.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Rarely seenHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.4The figure this clause puts a number on, taken from the broker's own words.
This Agreement is an integral part of the public documents package, pursuant to which the Company provides services (including the services of financial and informational nature, etc.) to its Clients.
Where it sits: section 3 of 31 in the Terms of Use, near the start. We counted the numbered sections in the Terms of Use. This clause sits in section 3 of 31, about 10% of the way through. A fee written on the first page and the same fee written near the end are not the same disclosure.
Firms licensed by the FCA or CySEC must give a retail client a written agreement before trading, setting out the service, the costs, the complaints route and the law that governs it. Hankotrade's published set contains none of those things.
Hankotrade is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.
Our readingOur own comment on the clause, not the broker's words. Anything we quote is marked as a quotation.A retail broker almost always publishes a client agreement that names the contracting company, the governing law and a court. Hankotrade publishes four web pages, and the one that calls itself an agreement is about using the website.
- Worse together with Exhibit 15Read these two clauses together. Each one costs more because the other exists. With no agreement and no court, the only route left is an email to the firm you are complaining about.
