Markets4you can charge you up to 10% of a deposit and up to 5% of a withdrawal if it decides you or a group of clients are misusing its services. Clause 3.8 of the Client Agreement puts that decision in its sole discretion and sets no test you can check.
Why this matters
You deposit $1,000 and $100 of it can disappear before your first trade. Nothing in the clause makes Markets4you warn you first or show you what the payment provider actually charged.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Harder than usualHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.10%The figure this clause puts a number on, taken from the broker's own words.
where the Company in its justified opinion has reasons to believe that the Client or a Group of Clients misuses the Company’s Services, the Company’s in its sole discretion has a right to collect from the Client the relevant Client fund deposit/ withdrawal fees charged by the respective payment system providers in an amount of up to 10% from the Client’s respective deposit and up to 5% from the withdrawal amounts.
What it costsThe same clause worked out on a round number, so you can see it in money or in days. It is an example, not a quotation.A $1,000 deposit can be charged up to $100 under this clause. Withdrawing the remaining $900 can cost up to $45 more.
Firms licensed by the FCA and CySEC must disclose the costs and charges of a service to a retail client before that client trades. Clause 3.8 sets only a ceiling and leaves the amount and the trigger to the company's own judgement.
Markets4you is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.
