Lose money and NYX lets you withdraw all of it. Make a profit and it first wants 2,000 lots traded for every $100,000 you deposited.
Why this matters
A lot is 100,000 units of currency, so 2,000 lots on a $100,000 deposit is 200 million dollars of trading. Your profit sits with NYX until you get there.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Rarely seenHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.2000The figure this clause puts a number on, taken from the broker's own words.
If after the transactions, the balance of the account in question loses up to 75% of the total balance, the customer (user) will be able to withdraw all or part of the balance without any restrictions, but if the transactions result in a profit (benefit) in the account, the minimum volume of transactions per 100 thousand US is (2000 LOT) will be the standard trading lot.
Where it sits: section 10 of 24 in the Description of the agreement, 42% of the way through. We counted the numbered sections in the Description of the agreement. This clause sits in section 10 of 24, about 42% of the way through. A fee written on the first page and the same fee written near the end are not the same disclosure.
What it costsThe same clause worked out on a round number, so you can see it in money or in days. It is an example, not a quotation.Deposit $100,000 and finish in profit. NYX wants 2,000 standard lots traded first, which is 200 million dollars of currency bought and sold.
Firms licensed by the FCA or CySEC hold a retail client's money so the client can ask for it back at any time. This contract makes the return of a profitable account's balance conditional on a trading volume.
NYX is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.
Our readingOur own comment on the clause, not the broker's words. Anything we quote is marked as a quotation.A volume condition normally attaches to a bonus the broker gave you. This one attaches to your own deposit, and it switches on only when the account is in profit.
- Worse together with Exhibit 3Read these two clauses together. Each one costs more because the other exists.Trade too little and the 15% commission applies, trade into profit and the 2,000 lot rule applies, so both ways out have a price.
