PanEn is a licensed Indonesian futures broker. Its contract leaves out what trading costs and how you get paid. No commission rate appears anywhere on its site, and no clause covers withdrawals. You get 2 x 24 hours to challenge a trade before PanEn's confirmation stands as correct. Its own two sites publish different numbers for the same USD client account.

The numbers in this contractFigures taken from this broker's own clauses, so the labels differ from broker to broker. The four in the panel above are the same on every report.

2 of these 2 figures come from a clause we rate critical, which means it can take your money or your profit rather than only delay it.

What the documents say

16 clauses worth knowing about, worst first, each quoted from PanEn Kapital Berjangka's own files

01

PanEn's contract sets no withdrawal timetable, no fee and no deadline for paying you. Its FAQ says withdrawals follow the deposit method or PanEn's own policy. That policy is published nowhere.

Why this matters

You cannot find out, before you deposit, how long PanEn may take to send your money back or what it will cost. If a payout stalls, no published clause gives you a date to hold PanEn to.

Anda dapat melakukan deposit dana menggunakan transfer bank. Penarikan biasanya diproses menggunakan metode yang sama atau sesuai kebijakan kami untuk memastikan keamanan dan kepatuhan.
Quoted in FAQ

Set against a regulated standard: FCA (UK), CySEC (Cyprus)

Firms licensed by the FCA or CySEC must tell a retail client how withdrawals work before they trade, and must pay a withdrawal request promptly. PanEn's contract says nothing about withdrawals at all.

PanEn Kapital Berjangka is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

  • Worse together with Exhibit 8With no withdrawal rule to point at, the clause letting PanEn move your funds without notice has nothing standing against it.
02

You get 2 x 24 hours from receiving a trade confirmation to object to it. Clause 15 then treats PanEn's confirmation as correct and valid. Your silence closes the question.

Why this matters

A confirmation you read late, or never notice, becomes the agreed record of your trade after two days. PanEn's complaints page never mentions this deadline, so the page you would read about complaining does not tell you the clock has already run.

What it costsA confirmation that reaches you on Monday can no longer be challenged from Wednesday. The 2 x 24 hours run from the day it arrives, not from the day you spot the problem.

Set against a regulated standard: FCA (UK), CySEC (Cyprus)

Firms licensed by the FCA or CySEC must give a retail client months to bring a complaint, and must point them to an independent ombudsman. This contract settles the point after two days of silence.

PanEn Kapital Berjangka is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

PanEn publishes two different numbers for the same Panin USD segregated account. The contract in the client area gives 1006.007.386. The legality page on its main site gives 1006001386, one digit apart.

Why this matters

You have to pick one of the two when you send a USD deposit, and a transfer to a number that is not the broker's segregated account is money the broker never receives. PanEn's own fraud warning tells clients to transfer only to its registered segregated account.

Our readingClient money account numbers are normally published once, in one place. Here the same bank's USD account carries two different numbers on two of PanEn's own pages, and a reader has no way to tell which one the bank will accept.

  • Worse together with Exhibit 15The same two sites also disagree on the licence numbers, so neither page can be used to check the other.
04

Your duty to top up margin is not capped at the margin you first paid in. Clause 7 lets PanEn close some or all of your open positions, with or without telling you first. PanEn takes no responsibility for the loss that follows.

In plain words

Negative balance protection is a limit that stops you owing more than you put in. Without it, one fast market move can leave you owing the broker money on top of your deposit.

Why this matters

You can end up owing PanEn more than you ever deposited. There is no negative balance protection here, which means no clause writes off a loss that takes your account below zero.

Set against a regulated standard: FCA (UK), ESMA (EU)

Firms under the FCA and the ESMA retail rules must give a retail client negative balance protection, so a client cannot lose more than the money in the account. This contract says the call margin duty is not limited to the initial margin.

PanEn Kapital Berjangka is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

PanEn can charge commission in an amount it sets from time to time, under clause 17. No fee schedule, spread table or minimum appears on its site or in the contract. Clause 3 also puts transaction fees, tax, service charges and interest at the prevailing rate on you.

Why this matters

You cannot work out what a trade costs before you place it, and you have no figure to compare with another broker. One protection survives: clause 17 says changes to fees and other charges must be agreed in writing by both sides.

Where it sits: section 49 of 104 in the Ketentuan Penggunaan Client Area Panen Kapital Berjangka, 47% of the way through.

Set against a regulated standard: FCA (UK), CySEC (Cyprus)

Firms licensed by the FCA or CySEC must disclose costs and charges to a retail client before they trade. PanEn's platform page advertises low commission, names no figure, and the contract leaves the amount to PanEn.

PanEn Kapital Berjangka is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

PanEn's public pages and its own contract disagree on cost, speed and where to send money

Two different numbers for the same Panin USD client account are published by PT Panen Kapital Berjangka, one in the contract and one on its legality page. The platform page promises orders in milliseconds, while clause 4 ties execution to system conditions and clause 14 drops responsibility for delay. The public terms page, on both PanEn sites, still shows the template's own placeholder and no terms.

Promise against contract2 clauses flagged

PanEn's platform page promises orders processed in milliseconds. Clause 4 says execution depends on the conditions and the trading system in force, and may produce a time difference. Clause 14 removes PanEn's responsibility for delays.

Why this matters

A slow fill costs you the difference between the price you clicked and the price you got. The contract gives you no speed to hold PanEn to, and no remedy when a delay moves the price against you.

Why this matters

You cannot read what you are agreeing to before you hand over your identity documents and register. The Indonesian site disclaimer on the same page also breaks off mid sentence, while the English version of it is complete.

PanEn can call for margin without limit and move your funds without telling you

Clause 6 says your call margin duty is not limited to the margin you first paid in. Clause 7 lets PT Panen Kapital Berjangka close your open positions with or without notice, and clause 19 lets it move funds between your accounts before telling you. Clause 25 then treats your next order as agreement to a change in the terms.

Broker discretion2 clauses flagged

Clause 19 lets PanEn shift funds from one account to another at any time, for margin, to pay a debt or to cut a deficit, without telling you first. You are told in writing after it has happened. Clause 9 also lets PanEn take payment for its costs out of your funds.

Why this matters

Money you were about to withdraw can be gone before you know it moved, and the first you hear of it is a notice after the fact.

Exhibit 8WarningHarder than usual

Clause 25 treats placing another order as agreement to a change PanEn has notified in writing. Clause 27 goes further, saying the terms may change at any time without consent in advance. The same contract gives you two different answers about being told.

Two days of silence settles a trade dispute in PanEn's favour

Clause 15 gives you 2 x 24 hours to object to a trade confirmation from PT Panen Kapital Berjangka, and after that it counts as correct and valid. PanEn's complaints page sets out a full escalation route and a 21 working day deadline on itself, and never mentions the two day cut off. Clause 21 also has you confirm a risk document PanEn does not publish.

Complaint deadlines1 clause flagged

You acknowledge receiving and understanding the risk disclosure document, the Dokumen Pemberitahuan Adanya Risiko, when you tick the terms at registration. Clause 21 is that acknowledgement. No such document appears anywhere on PanEn's public pages.

Why this matters

That acknowledgement is what a broker points to later when a client says nobody warned them. You cannot read the document before you agree that you have read it.

PanEn collects your face, your voice and your debts, and keeps them with no end date

The privacy policy of PT Panen Kapital Berjangka keeps your data as long as its business needs it where no law sets a period, and names no way to ask for deletion. Clause 18 lets PanEn investigate your personal and business debts through banks and credit checking agencies. Clause 27 passes your identity data to an electronic certificate provider, in a sentence where the list of providers was never filled in.

Your data3 clauses flagged

Clause 27 has you authorise PanEn to pass some or all of your personal data to Privy.id for an electronic certificate. Where the clause should list those certificate providers, it carries an instruction to the website editor instead. The same clause has you release PanEn from responsibility for processing inaccurate personal data.

Why this matters

You consent to a transfer of your identity details to parties the contract cannot show you. If that data is then processed wrongly, the clause you ticked hands the responsibility back to you.

The privacy policy keeps your data as long as PanEn's business needs it, where no law sets a period, and it names no way to ask for deletion. Clause 18 of the terms lets PanEn contact your bank, other brokers and credit checking agencies, and investigate your personal and business debts.

Why this matters

Your face image, voice recording, mother's maiden name and tax number sit in PanEn's systems with no end date you can point to. Nothing in the policy tells you who to ask to have them removed.

PanEn can refuse your order on a fairness test it does not define

Clause 4 lets PT Panen Kapital Berjangka reject an order when it judges the price unreasonable, with nothing defining the test. Clause 11 admits PanEn and its affiliates may hold market positions and give recommendations that do not match them. The market maker behind its alternative trading system products is not named in any document.

Clause 4 lets PanEn refuse your order when it judges the price offered or asked to be unreasonable, and nothing defines that test. Clause 11 admits PanEn and its affiliates may hold market positions and give recommendations that do not match them. No document names the market maker on the other side of your trade.

In plain words

On a principal basis, as your counterparty, means the broker takes the other side of your trade itself. Your loss is then the firm’s gain, so it has an interest in how your trade ends.

Why this matters

Your order can be turned down at the moment the price moves your way, and the contract gives you no standard to measure that against. You also cannot find out who profits when you lose, because the participating market maker is never named.

Set against a regulated standard: FCA (UK), CySEC (Cyprus)

Firms licensed by the FCA or CySEC must publish a conflicts of interest policy and tell a retail client when the firm or a related party is the counterparty to their trade. PanEn publishes no conflicts policy, and the market maker behind its alternative trading system products is not named in any document.

PanEn Kapital Berjangka is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

A dispute stays in Jakarta, at BAKTI or the South Jakarta court

Clause 26 keeps a dispute with PT Panen Kapital Berjangka in Indonesia, at BAKTI arbitration or the South Jakarta District Court. For an Indonesian broker with Indonesian clients that is normal, and it beats an offshore forum. PanEn's complaints page adds the futures exchange as a tier, which the contract does not mention.

Where you argue1 clause flagged

A dispute goes first to discussion between you and PanEn, then to BAKTI arbitration or the South Jakarta District Court, under clause 26. For a broker whose clients are in Indonesia, that is a domestic forum and a normal one.

Why this matters

You are not pushed offshore to argue your case. PanEn's complaints page adds a tier the contract leaves out, the futures exchange, so the two routes do not match.

Two PanEn sites publish two different sets of licence numbers

PT Panen Kapital Berjangka holds a Bappebti licence and a Jakarta Futures Exchange membership, and its main site links both to the regulators' own registers. The older panenfx.co.id legality page is still live and misspells the regulator inside the licence number. Neither page names a body behind the ISO 27001 number it prints.

Licence paperwork1 clause flagged

PanEn's main site lists its Bappebti licence as 13/BAPPEBTI/SI/03/2008 and links it to the regulator's own register. The legality page still live at panenfx.co.id spells the regulator wrong, as 13/BAPPEPTI/SI/03/2008, and gives different KBI and Aspebtindo numbers. The ISO 27001 line names no certifying body on either page.

Why this matters

A client who checks the licence from the older site searches a number the register does not hold. The main site does link straight through to Bappebti, the Jakarta Futures Exchange and KBI, so that is the route to use.

Who the contract is with

PT Panen Kapital Berjangka

Your contract is with PT Panen Kapital Berjangka, a Jakarta futures broker at Panen Tower, Jl. Patal Senayan No. 31. The same company runs the PanenFx brand and both panenkapitalberjangka.co.id and panenfx.co.id, and no second or offshore entity appears in any document. Its documents name the Jakarta Futures Exchange and PT Kliring Berjangka Indonesia for clearing, and segregated accounts at BCA and Panin. For the alternative trading system products, the site footer says PanEn works with a participating market maker in Indonesia, and no document names that firm.

Quotations are copied verbatim from the documents named above, with the clause number and the page each one came from. Where a clause is quoted in another language, the original is shown first and the English is a translation.

The plain-language parts, what a clause means for a client, how ordinary it is, and how it reads against a regulated standard, are WIKILIX's analysis and are labelled as such on every card. This is a reading of public documents, not legal advice and not an allegation of wrongdoing.

In fairness, and what we could not check

A reader who knows the edges of the work can trust the middle of it

Client money sits in segregated accounts at BCA and Panin that the contract names by number, and the main site links its Bappebti licence straight to the regulator's own register. PanEn publishes a real complaints procedure. It sets out three tiers of escalation, a 21 working day deadline on itself, and the regulator's online complaints portal, and it names a complaints unit with its own phone number and email. Its homepage warns clients never to transfer anywhere but the registered segregated account, and says PanEn never offers fixed returns or profit sharing. Nothing in these documents lets PanEn cancel a trade, void your profit or charge a dormancy fee, and there is no bonus scheme to lock a deposit in. Clause 17 also requires any change in fees to be agreed in writing by both sides.

We read the four documents PanEn publishes, plus its complaints page, its FAQ and both versions of its legality page. We could not see the account opening steps that follow registration. Documents a client signs inside the client area may exist there, including the risk disclosure document the terms refer to, and none of them is published on the public site. No earlier version of any of these documents is available, so this is a first reading with nothing to compare against. The client area terms number two separate clauses 7 and print the same paragraph twice, so a clause number alone does not always locate a clause in that document.

Every quote has a link under it. Open the file, or the web page, and search it for the words we quote. The clause number next to the quote tells you where to look.

If the words are not there any more, the source may have changed after we read it. That is worth knowing too. We keep the date we read it, and a code worked out from its wording, so the quote stays checkable.

What a fingerprint is

A fingerprint is a code worked out from what a source says. Change one word and the code changes completely. We keep two codes for every file we read, and the panel on each source shows both.

The first is the code of the exact file we downloaded. The second is the code of its wording alone, with capital letters lowered and runs of spaces collapsed. When the same words are saved as a new file, the first code changes and the second one stays the same.

Only the first code can be worked out on your own computer. Save the file, then run one of these, putting the name of the file you saved where the example is. The panel on each source prints the command with that source's real file name already in it.

macOS or Linux:
  shasum -a 256 the-file-you-saved.pdf

Windows:
  certutil -hashfile the-file-you-saved.pdf SHA256

The two codes are different from each other, and they are not meant to match. Comparing one against the other proves nothing.

What a difference means, and what it does not

A different file code on its own proves nothing. A PDF saved again with a new date inside it is a new file saying exactly the same thing.

A different wording code means the words themselves changed. That is the one that matters, and it is why we keep it.

Even then, a change is not proof of bad faith. Companies update their documents. What this report says is what the document said on the day we read it, and every quote carries that date.

A source that is a web page and not a file has no file to save, so only the code of its wording is shown.

How this report is made

Every clause quoted above comes from a document PanEn Kapital Berjangka publishes on its own website, downloaded and hashed on the date shown, with the clause number and page recorded so any reader can check it. We do not allege anything the documents do not say, and we do not judge PanEn Kapital Berjangka on anything other than its own published terms and its own public marketing. Where a clause has a qualifier that softens it, the report says so. Last read Oct 10, 2026.

If you represent PanEn Kapital Berjangka and a clause has changed, been withdrawn, or is being read out of context, tell us and we will re-read the documents and update this page. Corrections from the broker are welcome and are published with the reading they change. Contact us.

This is a reading of a contract, not legal advice and not a ruling on PanEn Kapital Berjangka. Whether its licence is real and current is a separate check on the broker profile.
