When your account equity falls to 30% of the initial margin, Phillip Futures closes part or all of your positions. Clause 14 of the GOFX rules says the system does this without asking you, even while your top up is still arriving.
Why this matters
You can watch a transfer leave your bank and still lose the position it was meant to save. Anything still owed after the sale is yours to pay, and Phillip Futures does not have to write it off.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Harder than usualHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.30%The figure this clause puts a number on, taken from the broker's own words.
If the Customer's equity drops to 30% or less than the Initial Margin per lot, the system will automatically liquidate part or all of the Customer's position without the need to obtain prior approval from the Customer.
What it costsThe same clause worked out on a round number, so you can see it in money or in days. It is an example, not a quotation. On a position needing $1,000 of initial margin, Phillip Futures starts closing when your equity reaches $300. The low equity mark comes earlier, at $500.
Firms licensed by the FCA, and firms under the ESMA and CySEC measures for retail clients, must close a retail position at 50% of required margin and must not pursue the client for a negative balance. These rules close you out at 30% and make you settle any shortfall yourself.
Phillip Futures is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.
What happens, and whenThe Trigger column is what has to happen first. Once that point is reached, the broker may do what the next column says. Every rung names the clause it came from, so you can check it.
| Trigger | What the broker may then do | Clause |
|---|---|---|
| Equity under 50% | Phillip Futures marks the account low equity, places a closing order on your behalf and can switch off your trading access. | 13 |
| Margin call at market close | You must add funds or cut positions by 12.00 WIB the next day. | 9 |
| Equity at 30% or less | Phillip Futures closes every open position in the account, at its own discretion. | 13 |
| Shortfall left over | You are responsible for making good any deficit left in the account. | 13 |
- Worse together with Exhibit 2Read these two clauses together. Each one costs more because the other exists.Your access is switched off before the forced sale runs, so you cannot reduce the position yourself.
- Worse together with Exhibit 10Read these two clauses together. Each one costs more because the other exists. The equity figure you watch to avoid this is indicative only, and the firm's own statement decides whether the trigger was hit.
