Türkiye Finans is a licensed Turkish bank, and its contract is harder than its marketing. The form you must sign says you have five working days to dispute a payment. The information form Türkiye Finans makes you sign says you have five working days to ask for a wrong or unauthorised payment to be put right. Clause 12.19 of the contract behind it gives you thirteen months. Both texts put the burden of proving it on you.

Why this matters

A fraudulent debit you spot three weeks later is still yours to challenge, but the paper you signed tells you it is far too late. Believe that page and you never complain.

What it costsA wrong debit on a Monday is disputable until the Thursday under the signed form. Under clause 12.19 the same debit is disputable for thirteen months.

Set against a regulated standard: FCA (UK)

Firms licensed by the FCA must refund an unauthorised payment, carry the burden of proving the customer authorised it, and allow thirteen months to report one. This contract puts the burden on you in both texts, and its signature form states five working days.

TURKIYE FINANS is not licensed by this regulator, so this is a comparison of practice, not a finding of any breach.

On a participation account your share of any loss is 100% and Türkiye Finans takes none, under clause 5.1. Take your money out before maturity and clause 5.11 pays you back only what you put in, even when the money made a profit. Clause 5.10 also lets the bank refuse the early withdrawal.

Why this matters

You need your savings in month four of a six month term. The profit your money earned stays with the bank, and if the pot lost money you carry that loss in full.

What it costsYou place 100,000 TL for six months and withdraw in month four after the pool made a profit. Clause 5.11 pays you 100,000 TL and the profit stays with the bank.

Our readingLoss sharing is how a participation account works, and the bank not sharing the loss is set by Turkish law. Paying back only the principal when a profit was made is the part written in the bank's favour.

Türkiye Finans sells Happy Kart on the bonus you earn and spend. Clause 24.4 of the credit card agreement lets it wipe unused points at the end of each calendar year, and delete the points you built up with nothing in return if you cancel the card, let it lapse, or die. Clause 24.2 names Happy Kart as the one card whose points cannot be set against your card debt.

Why this matters

You shop for a year to build a bonus balance, then close the card. Your points vanish at that moment, and nobody owes you their value in cash or off your bill.

Clause 17.6 caps what you owe at 150 TL for the twenty four hours before you report a lost or stolen card. Miss that twenty four hour window and the same clause makes you liable for the full loss with no time limit. Clause 17.7 adds that anything spent earlier than those twenty four hours is yours too, even when you did report in time.

Why this matters

Your card is skimmed on a Friday and you notice on Monday. Under these two clauses every fraudulent withdrawal is yours to pay, and the 150 TL cap protects nothing.

What it costsSomeone spends 40,000 TL on your card over a weekend and you report on Monday. Clause 17.7 leaves the whole 40,000 TL with you.

Set against a regulated standard: FCA (UK)

Firms licensed by the FCA must refund unauthorised card payments and can only push the loss onto the customer where the customer acted fraudulently or with gross negligence. This contract shifts the whole loss onto you for anything outside a twenty four hour window.

  • Worse together with Exhibit 7A twenty four hour reporting rule is far harder to meet when the same contract records that you asked for no statements.

On the TFX Target platform your loss can exceed the amount of the trade itself, which item 13.2 of the risk form states outright. Clause 3.5 lets Türkiye Finans close every one of your positions with no warning once your collateral drops below a level the bank sets, and watching that level is your job, not the bank's.

In plain words

Negative balance protection is a limit that stops you owing more than you put in. Without it, one fast market move can leave you owing the broker money on top of your deposit.

Set against a regulated standard: FCA (UK), CySEC (Cyprus), ESMA (EU)

Firms licensed by the FCA, CySEC and other ESMA regimes must give retail clients negative balance protection on leveraged trading, so a client can never lose more than the money in the account. This contract says your loss can exceed the traded amount.

The form you sign gives you five days, the contract gives you thirteen months

Türkiye Finans states two different dispute deadlines in one file: five working days in the form you must sign, thirteen months in clause 12.19 behind it. Both texts put the burden of proof on you. Clause 14.2 treats a message from your email as yours and rules out refusing to pay when a stranger sent it, and clause 17.7 leaves card fraud older than twenty four hours entirely with you.

Clause 14.2 treats any message from your registered phone, email or fax as coming from you, and says Türkiye Finans need not check it or call you back. The same clause says you will not refuse to pay by claiming a third party sent it without your knowledge. Clause 14.4.2 adds that the bank is not liable for a copied signature, a trick or forgery.

Why this matters

Someone gets into your email and sends a transfer instruction. Under these clauses the payment stands, the loss is yours, and forgery is expressly not the bank's problem.

Türkiye Finans sells a bonus in Turkish and a bank in Arabic that its contracts do not match

The Happy Kart page tells you to earn bonus and spend it, while clause 24.4 of the credit card agreement deletes accumulated points with nothing paid back once the card ends, and clause 24.2 singles Happy Kart out as the card whose points cannot even reduce your bill. The Arabic site sells accounts, cards and mortgages with its own Arab customer line, and publishes no contract in Arabic. Its only link to the contracts shelf is written in Turkish.

Türkiye Finans runs a full Arabic site with accounts, cards, gold, mortgages and a dedicated line for Arab customers. It publishes its individual banking agreement, its fee form and its trading contract in Turkish only. The one link out to those contracts on the Arabic home page is labelled in Turkish.

Why this matters

You can be sold an account entirely in Arabic and never read a line of what you agreed to. The clauses on early withdrawal and card fraud exist only in a language the marketing never used.

Türkiye Finans charges you per page for your own records

The fee form charges 50 TL to 500 TL a page for records older than a year, and clause 23.10 has you declare you never wanted statements in the first place. Clause 12.17 makes records free for one year only. A 5% transaction tax is added to every fee in the form.

You need proof of a payment from two years ago for a court case or a tax return. A ten page history can cost you up to 5,000 TL before tax.

Cash from a current account arrives when Türkiye Finans is ready

Clause 4.2 requires one business day of notice before you can draw cash from your current account, then lets Türkiye Finans extend that one day as much as it decides is necessary. No outer limit is written anywhere. You pay the transport and storage costs in advance.

Türkiye Finans quotes the price, takes the other side, and can cancel the trade

Item 5 of the TFX Target form lets Türkiye Finans change the rates on its own platform unilaterally and in any way it wishes, and using the platform counts as accepting those rates. Item 4 lets it cover your trade with whichever institution it chooses. Item 6 then lets it cancel trades struck at prices it judges unreasonably wrong and take back what it calls the probable unjust gain.

After ten years of silence your money becomes the state fund's income

Clause 24.1 makes an account time barred after ten years with no request, transaction or instruction, profit share included. Türkiye Finans sends a registered letter only where the balance is 1,000 TL or more. Anything unclaimed by 15 June passes to the savings deposit insurance fund and is booked as that fund's income.

A Turkish bank with deposit insurance written into the contract

Clause 1 names Türkiye Finans Katılım Bankası A.Ş. in Ümraniye, Istanbul as the party you contract with, and clause 23.16 puts your current and participation accounts inside the savings deposit insurance fund up to 1,200,000 TL. This is a Turkish participation bank in the Turkish banking regime, and its own trading contract names the BDDK as the regulator. The cover does not extend to a loss on a participation account.

Who the contract is with

Türkiye Finans Katılım Bankası A.Ş.

You contract with Türkiye Finans Katılım Bankası A.Ş. at İnkilâp Mah. Sokullu Cad. No: 6/3 Ümraniye, Istanbul, named in clause 1 of the banking agreement. This is a Turkish participation bank inside the Turkish banking regime: its own trading contract defines the BDDK as the banking regulator, and clause 23.16 puts your accounts inside the savings deposit insurance fund. The bank's own footer states it is an SNB institution, and clause 30.1 pulls the sanctions rules of the country where its parent sits into your contract. There is no offshore entity and no second company here.

Its fee form gives you 30 days notice of any increase and 15 days to walk away with no extra charge. Clause 23.16 states that current and participation accounts are insured by the savings deposit insurance fund up to 1,200,000 TL. Clause 5.4 stops the bank cutting your agreed profit rate before maturity while your balance is unchanged. Disputes go to Turkish law and Turkish courts, and the contract names real independent routes: the participation banks association arbitration board and the consumer arbitration boards. The Arabic product page also says openly that no return is fixed or promised in advance.

The main individual banking agreement is published as a picture of a document, so no text can be read out of it. We read the bank's own digital copy of the same agreement instead, and every quotation credited to it comes from there. We read the fee form, the TFX Target platform contract and the short distance contract in full. We read only the points and payment sections of the credit card agreement, so treat the rest of it as unread. We did not read the foreign exchange platform information form or the privacy notice at all. The one file collected for this reading was a promotional page rather than a contract, so we found the contracts shelf ourselves and read from there. Türkiye Finans publishes all of these contracts in Turkish only, and we did not compare today's wording against the dated versions in its own archive.

Open the source and search for the words

Every quote has a link under it. Open the file, or the web page, and search it for the words we quote. The clause number next to the quote tells you where to look.

If the words are not there any more, the source may have changed after we read it. That is worth knowing too. We keep the date we read it, and a code worked out from its wording, so the quote stays checkable.

What a fingerprint is

A fingerprint is a code worked out from what a source says. Change one word and the code changes completely. We keep two codes for every file we read, and the panel on each source shows both.

The first is the code of the exact file we downloaded. The second is the code of its wording alone, with capital letters lowered and runs of spaces collapsed. When the same words are saved as a new file, the first code changes and the second one stays the same.

Only the first code can be worked out on your own computer. Save the file, then run one of these, putting the name of the file you saved where the example is. The panel on each source prints the command with that source's real file name already in it.

macOS or Linux:

The two codes are different from each other, and they are not meant to match. Comparing one against the other proves nothing.

What a difference means, and what it does not

A different file code on its own proves nothing. A PDF saved again with a new date inside it is a new file saying exactly the same thing.

A different wording code means the words themselves changed. That is the one that matters, and it is why we keep it.

Even then, a change is not proof of bad faith. Companies update their documents. What this report says is what the document said on the day we read it, and every quote carries that date.

A source that is a web page and not a file has no file to save, so only the code of its wording is shown.
