Vantage tells you on its fund insurance page that client money sits apart from its own funds. The client agreement says your payment is not client money at all. It says the money buys a Reciprocal Obligation from Vantage instead.
Why this matters
If Vantage fails, the question is whether your balance is money held for you or a debt the company owes you. Its own gold addendum says you may rank as an unsecured creditor.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Rarely seenHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.
When Vantage Markets accepts money from a Client in connection with an Order, a Margin Call or a Deposit, the Client immediately receives Reciprocal Obligations from Vantage Markets under the Trade Contract Terms. The payment is not “client money”, but rather has purchased that Reciprocal Obligation from Vantage Markets.
Where it sits: section 27 of 67 in the Vantage Markets (Pty) Ltd Client Agreement, 40% of the way through. We counted the numbered sections in the Vantage Markets (Pty) Ltd Client Agreement. This clause sits in section 27 of 67, about 40% of the way through. A fee written on the first page and the same fee written near the end are not the same disclosure.
Firms licensed by the FCA, ASIC or CySEC must hold a retail client's money as client money, segregated and held for the client. This contract states the payment is not client money.
Vantage is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.
