WesternFX can refuse to pay profits on trades it calls unethical. Closing more than 10% of your volume inside three minutes counts, and so does scalping.
Why this matters
Short trades are normal for most active traders. If WesternFX decides too many of yours closed quickly, it keeps the profit those trades made. Nothing in the clause requires it to warn you first.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Harder than usualHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.10%The figure this clause puts a number on, taken from the broker's own words.
In the event that more than 10% of the Customer trading volume was executed using an unethical system, WesternFX reserves the right to refuse paying the profits generated from these transactions.
Where it sits: section 4 of 28 in the Trading and Execution Risks, near the start. We counted the numbered sections in the Trading and Execution Risks. This clause sits in section 4 of 28, about 14% of the way through. A fee written on the first page and the same fee written near the end are not the same disclosure.
- Worse together with Exhibit 16Read these two clauses together. Each one costs more because the other exists. The same section lets WesternFX close the account as well as keep the profit.
- Worse together with Exhibit 2Read these two clauses together. Each one costs more because the other exists. Two documents give two separate routes to removing a profit after it was made.
