What XINHUIBAO legally published, but does not want you to read

Every clause below is published by XINHUIBAO itself, on its own website, today. The finding is not that the text exists. It is the distance between what a client is shown and what a client agreed to. Read from its own documents on .

Contracting entity: Xinhuibao Precious Metals Limited

XINHUIBAO can take 6% of your deposit as a withdrawal fee if you do not trade enough. It can deduct your profit when it suspects manipulation, and freeze withdrawals until it decides the matter is closed. Since March it counts any position held under three minutes as scalping. The binding contract exists in Chinese only, while the English pages invite you to open an account.

Notice1

section 89 of 94is where the deepest clause sits, 95% of the way into the document it is in

The numbers in this contractFigures taken from this broker's own clauses, so the labels differ from broker to broker. The four in the panel above are the same on every report.

2 of these 3 figures come from a clause we rate critical, which means it can take your money or your profit rather than only delay it.

What the documents say

14 clauses worth knowing about, worst first, each quoted from XINHUIBAO's own files

01

Trade less than half of what you paid in, and XINHUIBAO takes 6% of the deposit when you withdraw. Meet the volume and you get three free withdrawals a day. The fourth costs 5% of that withdrawal.

Why this matters

You can put money in, decide not to trade, and get back less than you sent. The page that explains how to withdraw never mentions this charge.

Exhibit 1CriticalRarely seen6%

Read from the broker's site on Open the reference

Buried at section 87 of 94 in the 使用协议 (鑫汇宝客户协议书), 93% of the way through.

What it costsYou deposit $1,000 and trade $400 of volume, under the half required. XINHUIBAO keeps $60 and returns $940.

Set against a regulated standard: FCA (UK), CySEC (Cyprus)

Firms licensed by the FCA or CySEC must give a retail client the costs and charges of the service before they trade. XINHUIBAO puts this one in an appendix at the end of the client agreement.

XINHUIBAO is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

Our readingThe charge is calculated on the deposit, not on the amount withdrawn. It does not shrink when you take out less, so a client withdrawing in parts pays it on the full sum they paid in.

  • Worse together with Exhibit 3Trading fast to reach the volume can be read as scalping, which lets XINHUIBAO cancel the trades and freeze the payout.
02

If XINHUIBAO suspects an account of manipulating its prices or platform, it can deduct the profit that activity earned and every rebate it has paid you. Suspicion is the whole test. No proof, no notice, no appeal.

Why this matters

Money already showing in your balance can be removed while XINHUIBAO investigates its own suspicion. It then settles any argument about that deduction itself, using what the contract calls absolute discretion.

Read from the broker's site on Open the reference

Where it sits: section 27 of 94 in the 使用协议 (鑫汇宝客户协议书), 29% of the way through.

Set against a regulated standard: FCA (UK), CySEC (Cyprus)

Firms licensed by the FCA or CySEC must give a complainant a reasoned answer and access to an independent scheme. This contract makes XINHUIBAO the investigator and the final decision maker on the same facts.

XINHUIBAO is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

  • Worse together with Exhibit 3One clause takes the profit, the next holds the rest of the balance until XINHUIBAO says the matter is fully resolved.
03

XINHUIBAO now counts holding a position for less than three minutes as scalping, and bans it. Trades it labels arbitrage or scalping can be cancelled. It can freeze your withdrawals until the problem is completely resolved, and sets no deadline on that.

Why this matters

A fast exit during a news spike meets this definition. Your money then stays where it is until XINHUIBAO alone decides the question is closed.

Exhibit 3CriticalHarder than usualNew

鑫汇宝不容许客户在本公司的交易平台上进行此等套戥和剥头皮(持仓少于3分钟)行为。任何客户利用潜在「套戥」及「剥头皮」机会所从事的价格交易可能会被取消。

Read from the broker's site on Open the reference

Where it sits: section 22 of 94 in the 使用协议 (鑫汇宝客户协议书), near the start.

Set against a regulated standard: FCA (UK)

Firms licensed by the FCA must hold client money so it can be returned promptly, and cannot leave a hold open with no end date. This contract puts no outer limit on the freeze.

XINHUIBAO is not licensed by this regulator, so this is a comparison of practice, not a finding of any breach.

  • Worse together with Exhibit 1The fee rule pushes you to trade volume quickly, and quick trades are what this clause punishes.
04

Open more than one account with different documents and XINHUIBAO can freeze the funds in every account it treats as linked, lock their trading and close them by force. It does that without telling you first.

Why this matters

The freeze reaches accounts XINHUIBAO decides are connected, not only the one it objects to. Your balance stops being available on the day it makes that decision.

Exhibit 4CriticalHarder than usual

  • Worse together with Exhibit 2Linked accounts are frozen first, and the profit deduction clause then decides what comes out of them.
05

XINHUIBAO closes your positions automatically once the margin ratio hits 20%, and 100% at the weekend. The agreement says the loss can be larger than the money in the account. If the closeout leaves a shortfall, you pay it immediately.

In plain words

Negative balance protection is a limit that stops you owing more than you put in. Without it, one fast market move can leave you owing the broker money on top of your deposit.

Why this matters

There is no negative balance protection here, so a gap in the gold price can leave you owing XINHUIBAO money on top of losing your deposit. It can also raise the margin requirement whenever it likes.

Exhibit 5CriticalHarder than usual20%

否则,客户其保证金账户将可能于触发最低保证金比例20%(收市100%)时被系统自动执行平仓及造成相应的损失,且损失可能超过账户保证金水平。

Read from the broker's site on Open the reference

Where it sits: section 31 of 94 in the 使用协议 (鑫汇宝客户协议书), 33% of the way through.

What it costsAt the 100 times ratio the contract allows, $1,000 of margin carries a $100,000 position. A 1% move against you is $1,000, the whole deposit.

Set against a regulated standard: ESMA (EU), FCA (UK), CySEC (Cyprus)

Firms under ESMA, FCA and CySEC rules must give retail clients negative balance protection, so a client can never owe more than the account holds, and retail leverage on gold is capped. This contract does the opposite.

XINHUIBAO is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

  • Worse together with Exhibit 8The margin level can be raised at any time and the terms can change with no notice, so the number you signed up to is not fixed.

The English pages point at terms that only exist in Chinese

XINHUIBAO's English site tells you to read its Risk Disclosure and Terms and Conditions before investing, and both links lead to one short page holding neither. The contract that binds you is the Chinese client agreement, with the 6% exit charge and the three minute scalping rule in it.

Language gap1 clause flagged

The English pages invite you to open an account and tell you to read the Risk Disclosure and Terms and Conditions first. Both links lead to the same short page, which contains neither. The only binding contract is in Chinese.

Why this matters

If you cannot read Chinese, you agree to the 6% exit charge, the three minute scalping rule and the profit deduction clause without ever seeing them.

The exit is where XINHUIBAO charges you

XINHUIBAO takes 6% of your deposit when you withdraw after trading less than half of it, and 5% of any fourth withdrawal in a day. Hong Kong dollar payouts convert at a fixed 7.8 the company can change without notice. Neither charge appears on the page that explains how to withdraw.

Cost disclosure1 clause flagged

Every non dollar deposit is converted into US dollars. Take your money out in Hong Kong dollars and XINHUIBAO applies a fixed rate of 7.8, whatever the market is doing. It can change that rate without telling you.

Why this matters

You carry the bank charges and the rate difference on the way in and on the way out. The gap between the fixed rate and the real one is a cost you never see itemised.

XINHUIBAO can change the deal while your money is in it

Forced closeout starts at a 20% margin ratio, and 100% at weekends, with losses that can exceed your deposit and a shortfall you must pay at once. XINHUIBAO can raise the margin requirement, widen the spread and rewrite any term by updating its website, with no notice. A second account in your name freezes the funds in every account it treats as linked.

Broker discretion1 clause flagged

XINHUIBAO can amend, cancel or replace any term whenever it decides to. It updates the website and the app directly, with no advance notice and no announcement. Watching for changes is left to you.

Why this matters

The fee, the margin level and the closure rules can all move while your money sits there. You are treated as accepting each change from the day it appears.

Set against a regulated standard: FCA (UK), CySEC (Cyprus)

Firms licensed by the FCA or CySEC must give a retail client advance written notice of a change to the contract, with time to object or leave. This contract replaces that with a duty on you to keep re reading the page.

XINHUIBAO is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

Every route to challenge XINHUIBAO is narrowed

XINHUIBAO answers only for its own deliberate wrongdoing or fraud, and settles price error disputes at its absolute discretion. A notice counts as delivered the moment it is sent, received or not. The arbitration clause waives court and jury and runs in English, though you may open an account without signing it.

If it goes wrong2 clauses flagged

Agree to the arbitration clause and you give up your right to sue XINHUIBAO in court, jury included. One arbitrator hears it at the Hong Kong International Arbitration Centre, in English, while your contract is in Chinese. You can open an account without agreeing to it.

Why this matters

Signing that part means any claim is argued in a language the contract itself is not written in. Check the arbitration box on the account opening form before you tick it.

Identity checks1 clause flagged

Before your first withdrawal you must send colour images of both sides of your ID and of your bank card, then pass a face scan. Fail any part and XINHUIBAO will not accept the withdrawal request at all.

Why this matters

These checks arrive when you ask for your money, not when you deposit it. If the risk department decides you fail its identity, risk or money laundering review, it bars you from logging in and from trading.

Ninety quiet days and the account is treated as abandoned

XINHUIBAO charges nothing for dormancy, which is better than most. After 90 days with no login it treats the account as given up, and closure erases the transaction history with no notice and no copy kept.

In plain words

Dormancy means an account left unused.

Dormancy1 clause flagged

Do not log in for 90 days and XINHUIBAO treats the account as abandoned, which is one of its listed grounds for closing it. Once closed, it wipes the transaction history, keeps no copy and owes you no warning.

The documents this reading is based on

10 files, all published by XINHUIBAO. Each shows when we read it and a fingerprint of its wording.

WIKILIX keeps the copy of each file it read, and does not republish it: what is published is the fingerprint of its wording. Download the file yourself and hash its text, lowercased with runs of whitespace collapsed, and a matching fingerprint means the wording quoted above is still the wording XINHUIBAO publishes.

Who the contract is with

Xinhuibao Precious Metals Limited

The agreement opens by naming 香港鑫汇宝贵金属有限公司 as your counterparty. Its definitions clause then drops the 香港 and says 鑫汇宝贵金属有限公司, and the English footer gives Xinhuibao Precious Metals Limited, registered in Hong Kong, company number 2166791, at Unit 1512-1515, The Metropolis Tower, Hunghom. One company, three spellings, and only the registration number identifies it. No second entity appears, so a retail client contracts with this Hong Kong company and nobody else. No financial regulator is named in any document.

Quotations are copied verbatim from the documents named above, with the clause number and the page each one came from. Where a clause is quoted in another language, the original is shown first and the English is a translation.

The plain-language parts, what a clause means for a client, how ordinary it is, and how it reads against a regulated standard, are WIKILIX's analysis and are labelled as such on every card. This is a reading of public documents, not legal advice and not an allegation of wrongdoing.

In fairness, and what we could not check

A reader who knows the edges of the work can trust the middle of it

XINHUIBAO puts a real clock on payouts: approval within 2 hours of the request, money usually landing within 24 hours. Most brokers we read promise nothing that specific. The dormancy rule charges no fee at all. The risk disclosure says plainly that the company may be the direct counterparty to your trades. You can also open an account without agreeing to the arbitration clause, and the agreement says so outright.

Six of the ten pages on this broker's legal shelf are market commentary listings, not policies, and we read them only far enough to confirm that. The real policy set is two documents: the client agreement at 91pme.com/agreement and the risk disclosure, which the site publishes twice, at /risk and /risk.html. We read those end to end in Chinese, plus the English disclosure page. The anti money laundering statement, the privacy notice and the disclaimer named in the site footer were not among the files collected, so we did not read them. The privacy terms we quote come from inside the client agreement itself.

How to check any of this yourself

Every quote above links to the XINHUIBAO file it came from. This is what to do with it.

Open the three stepsFind the words in the source, work out the fingerprint, and read what a difference does and does not prove.

Open the source and search for the words

Every quote has a link under it. Open the file, or the web page, and search it for the words we quote. The clause number next to the quote tells you where to look.

If the words are not there any more, the source may have changed after we read it. That is worth knowing too. We keep the date we read it, and a code worked out from its wording, so the quote stays checkable.

What a fingerprint is

A fingerprint is a code worked out from what a source says. Change one word and the code changes completely. We keep two codes for every file we read, and the panel on each source shows both.

The first is the code of the exact file we downloaded. The second is the code of its wording alone, with capital letters lowered and runs of spaces collapsed. When the same words are saved as a new file, the first code changes and the second one stays the same.

Only the first code can be worked out on your own computer. Save the file, then run one of these, putting the name of the file you saved where the example is. The panel on each source prints the command with that source's real file name already in it.

macOS or Linux:
  shasum -a 256 the-file-you-saved.pdf

Windows:
  certutil -hashfile the-file-you-saved.pdf SHA256

The two codes are different from each other, and they are not meant to match. Comparing one against the other proves nothing.

What a difference means, and what it does not

A different file code on its own proves nothing. A PDF saved again with a new date inside it is a new file saying exactly the same thing.

A different wording code means the words themselves changed. That is the one that matters, and it is why we keep it.

Even then, a change is not proof of bad faith. Companies update their documents. What this report says is what the document said on the day we read it, and every quote carries that date.

A source that is a web page and not a file has no file to save, so only the code of its wording is shown.

How this report is made

Every clause quoted above comes from a document XINHUIBAO publishes on its own website, downloaded and hashed on the date shown, with the clause number and page recorded so any reader can check it. We do not allege anything the documents do not say, and we do not judge XINHUIBAO on anything other than its own published terms and its own public marketing. Where a clause has a qualifier that softens it, the report says so. Last read Sep 3, 2026.

If you represent XINHUIBAO and a clause has changed, been withdrawn, or is being read out of context, tell us and we will re-read the documents and update this page. Corrections from the broker are welcome and are published with the reading they change. Contact us.

This is a reading of a contract, not legal advice and not a ruling on XINHUIBAO. Whether its licence is real and current is a separate check on the broker profile.
