ZarVista's licences page tells you every client fund sits in a segregated account, completely separate from company money. The Terms of Business say your money may sit in an omnibus account that cannot be separated from ZarVista's.
Why this matters
If a bank or payment partner holding the pooled money fails, you join the queue as an unsecured claimant. ZarVista accepts no responsibility for that loss. The contract also gives you no security interest over your own account balance.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Harder than usualHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.
The Company may be required to hold client’s money in an account that is segregated from other clients and the Company’s money in compliance with current regulations, but this may not afford complete protection.
Firms licensed by the FCA or CySEC must hold retail client money in segregated accounts, reconcile it daily, and their clients are covered by a statutory compensation scheme. This contract says segregation may not afford complete protection, and no ZarVista document names any compensation scheme.
ZarVista is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.
- Worse together with Exhibit 19Read these two clauses together. Each one costs more because the other exists. The contract excludes the website promise and then has you confirm that no ZarVista representation persuaded you to sign.
