Despite Cabana Capitals first appearing in late 2017, there have been many doubts as to the legal status of Cabana Capitals and its adherence to regulatory standards.

Cabana Capitals Claims to have been founded in 2017 and operate globally under the name "Cabana Capitals Limited" based in Saint Vincent & the Grenadines and registered with an entity number by broker directories. However, there have not been any independent corroborations confirming that Cabana Capitals is licensed as a financial service provider by a governing body in the forex or CFD brokerage industry.

Cabana Capitals does not have any regulatory oversight from a primary financial regulator, including the United Kingdom's Financial Conduct Authority (FCA), Cyprus Securities and Exchange Commission (CySEC), or Australian Securities and Investments Commission (ASIC).
