The GTCFX regulations page tells you your maximum loss is capped at your account balance. The risk disclosure you accept says something else: if you cannot meet a margin call, GTCFX closes your position and you owe whatever is still missing.
Negative balance protection is a limit that stops you owing more than you put in. Without it, one fast market move can leave you owing the broker money on top of your deposit.
Why this matters
A gap that moves against you can leave you owing GTCFX money you never deposited. The page promising the cap calls it a regulator-mandated control, and the document that governs your account does not contain that cap.
Exhibit 1Every flagged clause gets its own number so you can point at this one. The number does not change, so a link to it keeps working.CriticalHow much this clause can cost you, in our reading. Critical can take your money or your profit. Warning can delay or limit it. Notice is simply worth knowing before you sign.Harder than usualHow ordinary this wording looks next to the contracts we read. This is our reading of the clause, not a count of other brokers.
If the market moves against you, you may be called upon to pay a substantial additional margin at short notice. If you fail to do so within the required time, your position may be liquidated at a loss, and you will be liable for any resulting deficit.
Firms licensed by the FCA and CySEC must give retail clients negative balance protection, so a client cannot lose more than the money in the account. The GTCFX risk disclosure says you will be liable for any resulting deficit.
GTCFX is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.
- Worse together with Exhibit 17Read these two clauses together. Each one costs more because the other exists. Both promises on that page, capped losses and segregated funds, are qualified in the documents you actually sign.
