What HANTEC FINANCIAL legally published, but does not want you to read

Every clause below is published by HANTEC FINANCIAL itself, on its own website, today. The finding is not that the text exists. It is the distance between what a client is shown and what a client agreed to. Read from its own documents on .

Contracting entity: Hantec Markets (V) Company Limited

Hantec's website promises fully segregated client funds in English, Vietnamese and Chinese. Its binding English contract says Hantec holds your deposit as its own money and you are only its creditor. The Chinese version of the same document says the opposite. If Hantec believes you misled it, it can drop its obligations to you, and deposits you barely trade cost 5%.

What the documents say

16 clauses worth knowing about, worst first, each quoted from HANTEC FINANCIAL's own files

01

Hantec's website promises fully segregated client accounts. Its contract says the opposite: Hantec holds your deposit on its own account, not in trust, and you are only its creditor.

In plain words

Liquidity providers are outside banks and brokers.

Why this matters

If Hantec becomes insolvent, your balance is only a debt it owes you, not money set aside for you. The contract also lets Hantec use pooled client money to pay a related company or a liquidity provider.

Exhibit 1CriticalRarely seen

Set against a regulated standard: ASIC (Australia), FCA (UK)

Firms licensed by ASIC or the FCA must keep retail client money apart from their own, in accounts held for clients, and ASIC bars licensees from using it for their own hedging. This contract holds your money on Hantec's own account and lets Hantec use it to meet obligations to a related company or a liquidity provider.

HANTEC FINANCIAL is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

Our readingMost retail broker agreements say client money sits in a separate client or trust account. Here the money becomes Hantec's, pooled with other clients' money, and your claim is a debt like any other creditor's.

  • Worse together with Exhibit 3Clause 10.1 makes your balance a debt Hantec owes you, and clause 12.2 lets Hantec declare itself relieved of its obligations without excluding that debt.
02

Hantec's Chinese Product Information Statement, in both Simplified and Traditional script, tells you it keeps client deposits apart from its own funds. The English version of the same document says Hantec holds them on its own account. Both versions say the English one prevails.

Why this matters

Hantec tells a Chinese reader the protection exists, while the binding English text takes it away. The Chinese Terms and Conditions also drop the sentence that makes you Hantec's creditor.

Our readingTranslations of client documents usually differ only in wording. Here the Chinese text states the reverse of the English on who owns your deposit, and a note in the same Chinese document says the English governs.

  • Same clause as Exhibit 1Both rest on the same client money passage: the English text that binds you and the Chinese text that tells you the reverse.
03

If Hantec has reason to believe you gave it false or misleading information, it can end your agreement at once. The same applies if it suspects money laundering or learns you are under official investigation. Hantec is then relieved of every obligation, including on trades you already hold.

Why this matters

The test is Hantec's own belief, with no proof and no review written into the clause. Nothing in it keeps your profit or your balance outside the obligations Hantec can walk away from.

Exhibit 3CriticalHarder than usual

Clause 12.2 in Terms and Conditions, p.27
Downloaded from the broker's site on Open the reference

Our readingClosing an account for false information or money laundering is common. Releasing the broker from trades already open, on its belief alone, is the part written in its favour. A separate clause keeps any rights the law itself gives you.

04

Fund your account through Hantec's payment gateway and you must use at least half the deposit as trading margin. If you do not, Hantec charges 5% of the deposit, which it calls administrative costs. The rule sits in a note on the deposit page, not in the contract or the fee guide.

Why this matters

Paying in and leaving without much trading costs you 5% of the deposit. Both Chinese deposit pages leave the charge out, and the Vietnamese page adds that the count restarts at zero after every withdrawal.

Exhibit 4WarningHarder than usual5%

When you using Hantec payment gateway for deposit, total trading margin must reach at least 50% of the total deposit, otherwise, 5% of the total deposit will be charged as administrative costs.

What it costsOn a $1,000 deposit you must use at least $500 as trading margin. If you do not, Hantec charges $50.

Set against a regulated standard: FCA (UK), CySEC (Cyprus)

Firms licensed by the FCA or CySEC must tell a retail client about all costs and charges before the client trades. Hantec states this charge only in a reminder under the deposit tables, and its Financial Services Guide, which sets out its fees, does not list it.

HANTEC FINANCIAL is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

  • Worse together with Exhibit 5Paying in and asking for the money back without trading triggers both the 5% charge and a possible anti-money-laundering review.
05

Hantec's contract sets no deadline for paying you out. It promises only reasonable efforts, and says Hantec is not liable under any circumstances for losses caused by a delay. Its licences page still promises your money is available for withdrawal whenever you need it.

Why this matters

If your money arrives late, the contract gives you no claim for what the delay costs you. A withdrawal soon after a deposit, with no trading, can also send you into an anti-money-laundering review. A May 2025 notice, still listed on Hantec's site, suspends withdrawal requests every weekend.

A belief or a bad price can undo what you earned

Clause 12.2 relieves Hantec of every obligation, including on open trades, once it has reason to believe you misled it or laundered money. An official investigation into you has the same effect. Hantec's Product Information Statement also lets it reverse, repair or open positions to recover its own losses from price errors.

Clawback rights1 clause flagged

When a delayed or wrong price costs you money, Hantec's trading rules say the loss is yours. When it costs Hantec, its Product Information Statement lets it reverse, repair or even open positions in your account to recover the loss.

Why this matters

Hantec can take back a profit you closed on a price it later calls inaccurate. Hantec decides which prices were wrong, and no deadline for a reversal appears in its documents.

Exhibit 6WarningHarder than usual

We are not responsible for any loss which you sustain as a result, and we may take action to recover any loss sustained by us as a result, including repairing, reversing, opening, and/or rolling over new or existing positions.
Clause 8(b)(xi) in Product Information Statement, p.18
Downloaded from the broker's site on Open the reference

Hantec can close your trades and change the rules alone

Hantec can set margin anywhere from 0.01% to 100% of a position's value and close positions at its absolute discretion, without notice. You owe any negative balance that follows. Hantec can also amend the agreement by website notice, binding you ten banking days later or at your next trade.

Unilateral control2 clauses flagged

Hantec can close your positions without notice whenever it chooses to use its absolute discretion, not only when your margin runs low. If a close-out leaves your account below zero, you owe Hantec the shortfall.

In plain words

Negative balance protection is a limit that stops you owing more than you put in. Without it, one fast market move can leave you owing the broker money on top of your deposit.

Why this matters

With leverage of up to 1:1000, a fast market can take your account below zero. Nothing in Hantec's documents gives you negative balance protection, the safeguard that limits your loss to the money in your account. A March 2026 notice also raises margin on existing gold and silver positions before every weekend close.

Exhibit 7WarningHarder than usual

If the Margin Level in your account drops below a predetermined level set by HF (e.g. 30% of an Initial Margin or 0.3% of the Notional Contract Amount) or if HF exercises its absolute discretion, then HF is entitled to close out your position at the prevailing market rate without notice to you.
Clause 3 in Product Information Statement, p.6
Downloaded from the broker's site on Open the reference
Set against a regulated standard: ASIC (Australia), ESMA (EU)

Firms licensed by ASIC, and firms selling CFDs in the EU under ESMA's rules, must give retail clients negative balance protection, so a retail client cannot lose more than the money in the account. Hantec's Product Information Statement says you remain liable for any negative position a close-out leaves.

HANTEC FINANCIAL is not licensed by these regulators, so this is a comparison of practice, not a finding of any breach.

  • Worse together with Exhibit 10The firm that decides when to close your position is the counterparty on the other side of it.

Hantec can amend your agreement at any time by posting a notice on its website. The change binds you ten banking days later, or sooner if you place a trade after it. Hantec can add new fees the same way.

Why this matters

One trade after a quiet website notice can bind you to terms you never saw. Changes cannot worsen trades you already hold, and you may end the agreement instead.

An unresolved dispute ends in arbitration under Vanuatu rules

After 30 days of mediation under Vanuatu rules, an unresolved dispute with Hantec goes to arbitration under Vanuatu rules. You pay half the mediator's costs. Hantec names no independent complaints body and charges USD 10 a minute for copies of the call recordings it keeps as evidence.

Complaint route1 clause flagged

Hantec names no independent complaints body for you. A dispute it does not settle goes to mediation under Vanuatu rules, and you pay half the mediator's costs. After 30 days unresolved, it moves to arbitration under Vanuatu rules.

Why this matters

You would face Hantec under Vanuatu mediation and arbitration rules, and share the cost. Hantec owns the call recordings it uses as evidence and charges USD 10 a minute for a copy. The Chinese text of the clause mentions neither Vanuatu nor the cost split.

The firm on the other side of your trade sets your costs

Hantec is the counterparty to every trade its clients place, and it quotes the prices itself. It can change overnight interest rates at any time, without notice, partly by reference to its own market positions. It can also decline a trade after you accept its price.

In plain words

On a principal basis, as your counterparty, means the broker takes the other side of your trade itself. Your loss is then the firm’s gain, so it has an interest in how your trade ends.

Principal dealing1 clause flagged

Hantec takes the other side of every trade you place and quotes the price itself. It can change the overnight interest you pay at any time, without notice, partly on the basis of its own market positions.

Why this matters

The firm that sets your price and your overnight interest is the firm on the other side of your trade. Hantec can also decline a trade after you accept its price, without giving a reason.

Twelve idle months cost $25 a year until the account closes

Hantec charges a $25 dormant account fee each year once an account has gone 12 months without a trade. When the balance can no longer cover the fee, Hantec takes the remainder and closes the account. Only the Financial Services Guide states the amount.

In plain words

Dormancy means an account left unused.

Dormancy1 clause flagged

If you place no trade for 12 months, Hantec charges a dormant account fee of $25 a year. When your balance can no longer cover it, Hantec takes what is left and closes the account.

Why this matters

Hantec drains a small forgotten balance to zero and then shuts the account. Only the Financial Services Guide states the amount, and Hantec's public website does not link that guide.

Hantec's extra costs sit in notes and side documents

Hantec charges 5% of a deposit made through its payment gateway when less than half of it is used as trading margin. That rule appears in a note on its English, Thai and Vietnamese deposit pages, not in the contract or the Chinese pages. Introducers can also have your spread widened, and copy trading carries a performance fee with no stated cap.

Cost disclosure2 clauses flagged

If you join through an introducing broker, it can ask Hantec to widen your spread, the gap between the buy and sell price. Hantec can pass that extra to the introducer, or pay it up to 80% of your spread cost.

Why this matters

The person who recommended Hantec can earn more when you pay more. The account page that advertises tight spreads does not mention it.

Exhibit 11NoticeStandard wording80%

This will be paid if the third party is an “introducing broker” and has requested that its clients be charged a premium to the standard HF spread, due to the added service they are providing to their clients.

What it costsIf your trading generates $1,000 in spread costs, Hantec can pay up to $800 of it to your introducer.

Hantec publishes no terms for its copy trading service, only a question and answer page. There, the strategy provider you copy sets its own performance fee as a share of your net profit, with no maximum stated.

Why this matters

The fee can be settled trade by trade, so you can pay on each winning trade while your overall result is a loss.

Vanuatu law governs, and Hantec can transfer your agreement

Hantec Markets (V) Company Limited's contract runs under Vanuatu law, with the Vanuatu courts as the only forum. Hantec can, acting reasonably, transfer its rights and duties under your agreement without your consent. Your only answer to a transfer is to end the agreement.

Governing law1 clause flagged

Your agreement runs under Vanuatu law, and you submit to the Vanuatu courts alone. Hantec can also, acting reasonably, transfer its rights and duties under the agreement to another party without asking you.

Why this matters

Vanuatu is far from the clients Hantec targets with local deposit methods in China, Thailand, Vietnam, Indonesia and Africa. If you object to a transfer, your only remedy is to end the agreement.

A Vanuatu company stands behind an ASIC headline

Hantec's client documents come from Hantec Markets (V) Company Limited under Vanuatu licence 40318, not from the group's ASIC-licensed Australian company. Its Product Information Statement and Financial Services Guide each say they are not a regulated document. Hantec's public website links none of its three contract documents.

Who you contract with2 clauses flagged

The company you sign with is Hantec Markets (V) Company Limited, licensed in Vanuatu. The ASIC licence the website leads with belongs to a different group company, which your documents never mention.

Why this matters

Australian client protections attach to the Australian company's clients, not to you. Hantec's Product Information Statement and Financial Services Guide each call themselves not a regulated document. The contract still cites Australia's Corporations Act and Privacy Act.

Who the contract is with

Hantec Markets (V) Company Limited

The Terms and Conditions, Product Information Statement and Financial Services Guide linked from Hantec's account-opening screens are all issued by Hantec Markets (V) Company Limited, registered in Vanuatu and holding Vanuatu Financial Services Licence 40318. The ASIC licence the website leads with belongs to Hantec Markets (Australia) PTY Ltd, which these documents never name. The Product Information Statement and the Financial Services Guide each state that they are not a regulated document. On its Hong Kong pages, Hantec says a third company, Hantec Bullion Limited, provides its services there.

Quotations are copied verbatim from the documents named above, with the clause number and the page each one came from. Where a clause is quoted in another language, the original is shown first and the English is a translation.

The plain-language parts, what a clause means for a client, how ordinary it is, and how it reads against a regulated standard, are WIKILIX's analysis and are labelled as such on every card. This is a reading of public documents, not legal advice and not an allegation of wrongdoing.

In fairness, and what we could not check

A reader who knows the edges of the work can trust the middle of it

Hantec's contract set is complete and dated. The Terms and Conditions, Product Information Statement and Financial Services Guide are all version 2.1 of 20 May 2024, in English and two Chinese scripts. The fee guide puts dollar figures on its dormant fee and administrative charges, which many offshore brokers leave vague. Clause 5.5.2 stops an amendment from worsening trades you already hold, and clause 13.3 keeps any rights the law itself gives you.

Hantec's public website does not link its contract. The Terms and Conditions, Product Information Statement and Financial Services Guide come from the addresses its account-opening screens link to on hantec.com. This review covers all three English documents in full. The Simplified Chinese Terms and Conditions and Product Information Statement are compared with the English only on client money, disputes and fees. The review also covers the client money passage of the Traditional Chinese Product Information Statement. The review does not cover the Traditional Chinese Terms and Conditions or either Chinese Financial Services Guide. On the trading rules page, the review covers the numbered rules and the forex table, not the table for every product. Four addresses on Hantec's site that looked like legal pages showed only a page-not-found screen. No earlier version of these documents is available for comparison. Documents shown only to logged-in clients, such as the client portal's download centre, are not covered.

How to check any of this yourself

Every quote above links to the HANTEC FINANCIAL file it came from. This is what to do with it.

Open the three stepsFind the words in the source, work out the fingerprint, and read what a difference does and does not prove.

Open the source and search for the words

Every quote has a link under it. Open the file, or the web page, and search it for the words we quote. The clause number next to the quote tells you where to look.

If the words are not there any more, the source may have changed after we read it. That is worth knowing too. We keep the date we read it, and a code worked out from its wording, so the quote stays checkable.

What a fingerprint is

A fingerprint is a code worked out from what a source says. Change one word and the code changes completely. We keep two codes for every file we read, and the panel on each source shows both.

The first is the code of the exact file we downloaded. The second is the code of its wording alone, with capital letters lowered and runs of spaces collapsed. When the same words are saved as a new file, the first code changes and the second one stays the same.

Only the first code can be worked out on your own computer. Save the file, then run one of these, putting the name of the file you saved where the example is. The panel on each source prints the command with that source's real file name already in it.

macOS or Linux:
  shasum -a 256 the-file-you-saved.pdf

Windows:
  certutil -hashfile the-file-you-saved.pdf SHA256

The two codes are different from each other, and they are not meant to match. Comparing one against the other proves nothing.

What a difference means, and what it does not

A different file code on its own proves nothing. A PDF saved again with a new date inside it is a new file saying exactly the same thing.

A different wording code means the words themselves changed. That is the one that matters, and it is why we keep it.

Even then, a change is not proof of bad faith. Companies update their documents. What this report says is what the document said on the day we read it, and every quote carries that date.

A source that is a web page and not a file has no file to save, so only the code of its wording is shown.

How this report is made

Every clause quoted above comes from a document HANTEC FINANCIAL publishes on its own website, downloaded and hashed on the date shown, with the clause number and page recorded so any reader can check it. We do not allege anything the documents do not say, and we do not judge HANTEC FINANCIAL on anything other than its own published terms and its own public marketing. Where a clause has a qualifier that softens it, the report says so. Last read Oct 21, 2026.
