InstaForex trades under two companies and the website you land on picks which one you get. Instant Trading EU Ltd is licensed in Cyprus. The main site is run from the British Virgin Islands, and its Arabic pages invite you to click past EU protection and sign up offshore. The Cyprus contract lets InstaForex reverse profits from trading it calls abusive, while stating that losses from the same trading cannot be reversed. Tell InstaForex you are taking it to court and it can close your account, with no notice, under clause 9.3 of the VPS agreement. The clause covers any account, not only the VPS one.

Why this matters

You have to choose between keeping access to your money and telling the firm you intend to sue it. Announce the claim and your trading account can be shut the same day.

Clause 12.2(g) lets InstaForex cancel your profits from trading it decides was abusive. The same clause then says losses from that trading cannot be reversed. Heads it keeps the money, tails you keep the loss.

Why this matters

If InstaForex rules against your trading, only the winning side of it is undone. You keep every losing trade and lose every profitable one, and nothing in the clause requires it to prove anything first.

Firms licensed by the FCA and CySEC must treat clients fairly and act in their best interests when exercising contractual discretion. This clause fixes the outcome of that discretion in the firm's favour before any facts are examined.

The Arabic pages on ifxinvest.net tell you the site does not comply with your country's law, then offer a button to see it anyway. Clicking it means you accept that registering will leave you outside EU rules, and outside the Cyprus company entirely.

In plain words

Negative balance protection is a limit that stops you owing more than you put in. Without it, one fast market move can leave you owing the broker money on top of your deposit.

Why this matters

One click moves you from a CySEC firm with compensation cover up to 20,000 euro to an offshore company in the British Virgin Islands. You lose the compensation fund, the complaints ombudsman and the guaranteed negative balance protection, and the page never lists what you gave up.

You get five business days to object to how a trade was executed. Miss that, and clause 10.17 treats the trade as valid and binding. Clause 13.3 says the same about your account statements.

Why this matters

The clock runs from the day the trade closed, not the day you spotted the problem. A holiday, an illness or a slow statement can take the whole window, and after it your silence counts as your agreement.

Put money into a pre-IPO order and you cannot take it out from two days before the listing until seven days after. Leave early and InstaForex charges 20% of the order value, and the same 20% applies from day 8 to day 93.

Why this matters

You lose control of the money for nine days at the most volatile moment, and then buying your way out costs a fifth of the position for the next three months.

The client agreement says your money is kept separate from the firm's money at all times. InstaForex's own 2025 capital report splits client money in two, and reports 2,014 thousand euro sitting in non-segregated accounts against 15,254 thousand segregated.

Why this matters

Money in a non-segregated account is not ring fenced the way the contract promises. If the firm failed, that portion would be harder to trace and slower to return than the segregated part.

InstaForex can reverse your profits and keep your losses on the same trades

Clause 12.2(g) lets InstaForex cancel profits from trading it calls abusive, then states that losses from that same trading cannot be reversed. Three other clauses let it decide after the event that money in your balance was never real profit: ex-dividend gains, rollover gap gains, and anything it suspects came from hedging at another broker. None of them gives you a test to argue against.

Profit that can be undone2 clauses flagged

Clause 10.14 lets InstaForex remove profit from trading around a dividend date, without telling you first, if it decides the profit was unjustified. Clause 15.9 lets it refuse a withdrawal built on profit from the rollover gap, because that is "not actual profit".

Why this matters

Both clauses let InstaForex decide after the event that money already showing in your balance does not count. Neither gives you a test to argue against or a right of appeal.

Clause 12.2(m) lets InstaForex cancel your trades or profits if it suspects you hedged a position using an account held at a different broker. Suspicion is the whole test.

Why this matters

What you do in an account InstaForex does not hold can cost you the profit in the account it does hold. The firm needs only a reason to believe, and it cannot see those other accounts to be right about them.

The Arabic site sells you a waiver of EU protection before it sells you an account

Arrive on InstaForex's Arabic pages and the first thing you see is a notice that the content does not comply with your country's law, next to a button to view it anyway. Clicking it means accepting that registration leaves you outside EU rules. The same pages count seven million clients and a shelf of best broker awards, while InstaForex's own Key Information Documents put the retail loss rate at 75.02%.

The Arabic pages lead with awards and the trust of more than 7,000,000 retail traders. InstaForex's own Key Information Documents put the figure that matters next to it: 75.02% of retail investor accounts lose money trading its CFDs.

Why this matters

The number that predicts your outcome is on page one of a document you were never sent. The number you were shown counts how many people signed up, not how many of them made money.

Where it sits: section 22 of 37 in the Key Information Document: Forex CFD, 59% of the way through.

There is no ceiling on the mark-up, and covered deposit fees can be taken back

Clause 18.3 states that there is no upper limit to the mark-up InstaForex builds into its spreads and swap points, and clause 20.3 lets it change both without notice on positions you already hold. Its own average spread table is described as indicative only. InstaForex pays your deposit fees, then reserves the right to debit them back out of a withdrawal if you stop trading.

InstaForex sets your price and states plainly that there is no ceiling on what it adds. Clause 18.3 says there is no upper limit to the mark-up in its spreads and swap points, and clause 20.3 lets it change both with immediate effect, without notice, on positions you already hold.

Why this matters

The cost of holding a position can rise while the position is open and before you are told. The published average spreads are described by the firm itself as indicative only, with no assurance they will be achievable again.

Deposit, decide not to trade, and the fees you were told were covered come off your withdrawal instead. The list of triggers is open ended: the document says "among others".

Pre-IPO money is locked for nine days and costs 20% to leave

A pre-IPO order cannot be withdrawn from two days before the listing until seven days after it, and exiting early costs 20% of the order value. That same 20% applies from day 8 to day 93. Once a termination notice is sent, clause 21.5(d) lets InstaForex refuse withdrawals altogether and hold your funds while it settles what it says you owe.

Clause 21.5(d) lets InstaForex refuse to let you withdraw money once a termination notice has gone out, and keep your funds while it settles anything it says you owe. Clause 15.16 lets it reverse a withdrawal back into your account if it is not satisfied with your paperwork.

Why this matters

Exit is the moment the withdrawal route can close. Either side can end the agreement on fourteen days notice, and in those fourteen days the payout tap is the firm's to turn off.

A trade closed inside two minutes is prohibited, and the terms can change under an open position

InstaForex defines scalping as any trade closed within two minutes, lists it as prohibited, and gives itself 15 working days to void the trade whether it is open or closed. Clause 20.2 lets it amend the agreement about positions you already hold, for thirteen listed reasons including a change in the level of inflation. On the website terms, continued use counts as acceptance and no notice is given at all.

Rules you can break by accident2 clauses flagged

The contract defines scalping as any trade closed within two minutes, lists it as a prohibited action, and gives InstaForex 15 working days to void the trade whether it is still open or already closed.

Why this matters

Closing a position quickly to cut a loss or take a small gain puts it inside the definition. For three weeks afterwards InstaForex can undo it, and repeat breaches let it end the agreement and cancel your open positions.

The deal you agreed to can be rewritten under a trade you are already in. On the website terms, your continued use of the site is treated as your acceptance of changes you were never sent.

Paperwork can be demanded at any time, including mid-withdrawal

InstaForex can request source of funds documents at any point, and clause 15.16 lets it reverse a withdrawal back into your account if it is not satisfied with what you send. Miss the 15 day verification deadline from first contact and it can end the relationship, returning funds only to the account they came from. No clause puts a limit on how long a review may run.

Why this matters

A verification review can start when you ask for your money rather than when you put it in. Nothing in the contract puts a deadline on how long that review may take.

InstaForex is your only counterparty and says client losses are firm gains

Clause 10.1 makes InstaForex the only execution venue for your trading, and its 2024 execution report shows it handled 99.99% of retail volume itself. Its own conflicts policy states that client losses are firm gains. Section 10 of that policy then has you consent in advance to being dealt with however InstaForex thinks fit, despite the conflict, without prior reference to you.

On a principal basis, as your counterparty, means the broker takes the other side of your trade itself. Your loss is then the firm’s gain, so it has an interest in how your trade ends.

InstaForex is the sole place your orders are executed, and its own conflicts policy states the position bluntly: client losses are firm gains. By signing, you agree in advance that it may deal with you however it thinks fit despite that conflict, without asking you.

Why this matters

There is no second venue to compare against and no external price to appeal to. Its own 2024 execution report shows it handled 99.99% of retail volume itself, and its Key Information Documents put the share of retail accounts that lose money at 75.02%.

Five euro a month until the balance reaches zero, with nothing refunded

InstaForex charges 5 euro a month on an inactive account with a positive balance, on the first day of each month, until the balance is brought to zero. Clause 16.3 says none of it comes back if you reactivate. The client agreement puts the trigger at six months without trading and the costs page footnote puts it at three, so the two documents disagree about when the charging begins.

Four bonus schemes marketed in Arabic, and no bonus terms anywhere in the legal set

The Arabic pages market a 30% bonus, an X bonus, gifts for deposits and a CPA bonus. We found no bonus terms document at all, although clause 27.2 says the conditions governing a trading benefit will be posted on the website. The contract also counts hunting of trading benefits as abusive trading, and lets InstaForex cancel swap free status it considers is being abused.

The Arabic site markets a 30% bonus, an X bonus, gifts for deposits and a CPA bonus. We found no bonus terms document anywhere in the legal set, although clause 27.2 says the terms governing a trading benefit will be posted on the website.

Why this matters

You cannot read the conditions attached to a bonus before you accept it. The contract also treats hunting of trading benefits as abusive trading, and lets InstaForex cancel swap free status it decides is being abused.

Cyprus law and Cyprus courts, and your account can be sold to someone else

Disputes with the Cyprus company are settled in the courts of the Republic of Cyprus under Cyprus law. Clause 29.9 lets InstaForex sell, transfer, assign or novate the whole agreement to a third party on fifteen business days notice. Clause 29.10 sends your account, your money, your trading history and your identification documents with it, and you cannot refuse.

Where a claim goes1 clause flagged

Disputes with the Cyprus company go to the courts of Cyprus under Cyprus law. Clause 29.9 also lets InstaForex sell, transfer or novate your agreement to a third party on fifteen business days notice, taking your account, your money and your records with it.

Why this matters

You cannot object to the buyer and you cannot stop the transfer. The company you end up contracting with may not be the one you chose.

Two companies behind one brand, and client money reported outside the segregated pool

Instant Trading EU Ltd holds CySEC licence 266/15 and gives retail clients compensation cover up to 20,000 euro. The main site belongs to a British Virgin Islands company whose own complaints procedure notes that its regulator does not award compensation. InstaForex's 2025 capital report also reports 2,014 thousand euro of client money in non-segregated accounts, while clause 14.5 promises segregation at all times.

The Cyprus company Instant Trading EU Ltd holds CySEC licence 266/15. The main site is run by a British Virgin Islands company its own complaints procedure calls InstaFinance LTD, and the Arabic footer gives that same registration number under a different name, then credits the services to InstaFintech Group.

Why this matters

Which company you sign with decides whether you have compensation cover, an ombudsman and negative balance protection. The offshore complaints route ends at a regulator that, in InstaForex's own words, does not award compensation.

The client agreement sets the inactivity trigger at six months and the costs page footnote sets it at three, so a client cannot tell from either document when the charging starts.

Who the contract is with

Instant Trading EU Ltd

Two companies use the InstaForex name. Instant Trading EU Ltd is registered in Cyprus (HE 266937) and licensed by CySEC under number 266/15. That is the company behind instaforex.eu and behind the client agreement quoted here. The main site ifxinvest.net belongs to a British Virgin Islands company, which its own complaints procedure names InstaFinance LTD, registration 1811672, licence SIBA/L/14/1082. The Arabic pages give that same registration number under a different name, and add a third: "Financial services are provided by InstaFintech Group." Only the Cyprus company gives you compensation fund cover up to 20,000 euro and negative balance protection.

In fairness, and what we could not check

A reader who knows the edges of the work can trust the middle of it

Instant Trading EU Ltd publishes far more than most brokers. Ten years of capital reports, eight years of execution quality reports, nine Key Information Documents, and a version number on every policy. Retail clients get negative balance protection in writing: "you will never lose more than the amounts you invested with us." Withdrawal requests are processed the same day when the paperwork is complete. Clause 11.2 also makes the firm absorb the losses from its own execution mistakes.

Six large PDFs came back empty and we did not read them: the OYS product sheets for Blockchain, GER40, SP500, UK100, US Small Caps and US Tech. Eleven more extracted so badly that we read them only in part and quoted nothing from them, including the Cyprus complaints procedure, the compensation fund notice, both cookie policies, the offshore privacy policy and four older execution reports. The client agreement runs to 41 pages and we read all but the closing glossary. We found no bonus terms at all, although the Arabic site markets four bonus schemes. Of the marketing pages, we read only the Arabic glossary page, so every claim quoted here comes from that one page.

Open the source and search for the words

Every quote has a link under it. Open the file, or the web page, and search it for the words we quote. The clause number next to the quote tells you where to look.

If the words are not there any more, the source may have changed after we read it. That is worth knowing too. We keep the date we read it, and a code worked out from its wording, so the quote stays checkable.

What a fingerprint is

A fingerprint is a code worked out from what a source says. Change one word and the code changes completely. We keep two codes for every file we read, and the panel on each source shows both.

The first is the code of the exact file we downloaded. The second is the code of its wording alone, with capital letters lowered and runs of spaces collapsed. When the same words are saved as a new file, the first code changes and the second one stays the same.

Only the first code can be worked out on your own computer. Save the file, then run one of these, putting the name of the file you saved where the example is. The panel on each source prints the command with that source's real file name already in it.

The two codes are different from each other, and they are not meant to match. Comparing one against the other proves nothing.

What a difference means, and what it does not

A different file code on its own proves nothing. A PDF saved again with a new date inside it is a new file saying exactly the same thing.

A different wording code means the words themselves changed. That is the one that matters, and it is why we keep it.

Even then, a change is not proof of bad faith. Companies update their documents. What this report says is what the document said on the day we read it, and every quote carries that date.

A source that is a web page and not a file has no file to save, so only the code of its wording is shown.

Every clause quoted above comes from a document InstaForex publishes on its own website, downloaded and hashed on the date shown, with the clause number and page recorded so any reader can check it. We do not allege anything the documents do not say, and we do not judge InstaForex on anything other than its own published terms and its own public marketing.
