Broker Summary
Summary of the broker
TMS is the retail trading brand of OANDA TMS Brokers S.A., a Polish brokerage house with its registered office at Rondo Daszyńskiego 1, 00-843 Warsaw. The company is entered in the Polish National Court Register under number KRS 0000204776, with tax number NIP 5262759131 and share capital of 3,537,560 PLN paid in full. Its own website states that it is supervised by the Komisja Nadzoru Finansowego, the Polish Financial Supervision Authority, under a permit dated 26 April 2004 (KPWiG-4021-54-1/2004). The firm now trades under the OANDA TMS name as part of the OANDA group.
What it offers. The CFD side of the business covers close to 1,800 contracts for difference: around 70 forex, index and commodity CFDs, more than 1,600 share CFDs, 13 cryptocurrency CFDs and roughly 40 ETF CFDs. A separate brokerage account gives access to more than 2,400 physical shares, including about 1,430 US and 200 Warsaw-listed stocks plus German, French, Spanish and UK markets, and around 200 ETFs from providers such as iShares, Vanguard, SPDR, Amundi and Xtrackers. Accounts can be held in PLN, EUR, USD and CZK.
Costs and leverage. Retail leverage is capped at 1:30, in line with the European rules that apply to a Polish investment firm. There is no commission on forex, index, commodity and cryptocurrency CFD trades, and the broker states there is no daily financing cost on the American and German index CFDs or on commodities. Cash equity commission is 0 PLN on US shares, 0.19% or a minimum of 5 PLN on the Warsaw exchange and 0.15% or a minimum of 5 EUR on the other European markets. ETF trades are free for the first ten transactions each month up to 200,000 EUR of turnover, then 0.10% subject to a minimum of 1 EUR, 1 USD or 5 PLN. The CFD account is banded by balance into Standard, Premium and Elite, with the two higher bands quoted at spreads up to 30% lower. Execution is described on the broker's own pages as a market-maker model, meaning the client trades against the firm rather than an outside venue.
Platforms and funding. MetaTrader 5 is the main platform, with a Windows installer, a browser version and mobile apps; on Linux and Unix only the browser version is offered. TradingView charting is integrated, and the firm's own mobile application is built on TradingView technology. Deposits are taken by payment card up to a 250,000 PLN limit, by bank transfer in PLN, USD and EUR with no limit, by mBank transfer, through Autopay and through Przelewy24. The card, bank and mBank channels are stated to be free of charge; Przelewy24 carries a 2% fee, as do the mBank and Płacę z Orange routes inside Autopay. Withdrawals from the brokerage account are described as processed immediately and reaching the client within one working day in the great majority of cases.
Who it suits. Retail and professional clients in Poland and in the European markets the firm's own onboarding accepts, who want a domestically supervised firm, a single account spanning CFDs and physical shares, and MetaTrader 5 rather than a proprietary terminal. The site and the client documentation are published in Polish, so it suits Polish-speaking clients best.
Honest caveats. The firm's own disclosure states that 76% of retail investor accounts lose money trading CFDs with it, and CFD leverage remains the main way clients lose capital quickly. Because execution is a market-maker model, the firm is the counterparty to client positions. Retail leverage of 1:30 will feel restrictive to anyone used to offshore terms, which is the trade-off for onshore supervision. The broker does not publish a minimum deposit or a headline spread figure, so entry costs have to be checked in the fee tables. A separate Maltese company, TMS Brokers Europe Ltd, once traded under the TMS Europe name and was dissolved in September 2020; the tmseurope.com domain now redirects to the Polish site, and anyone approached in the name of the Maltese entity should treat that as a warning sign. WIKILIX confirmed the operating company on the official Polish court register but was not able to confirm the licence against the regulator's own register in this review.

How we know
- 1The account-opening form at https://www.tms.pl/onboarding first asks whether the applicant lives in Poland; answering no reveals a residence selector whose leading, separately grouped block of served markets is Austria, Belgium, Bulgaria, Croatia, Denmark, Estonia, Finland, France, Greece, Spain, the Netherlands, Ireland, Lithuania, Malta, Portugal, the Czech Republic, Romania, Sweden, Slovakia, Slovenia, the United Kingdom and Latvia. Those plus Poland are recorded as explicitly accepted.
- 2The same selector also carries a long residual list of other jurisdictions, so no country can be read off it as refused. No block is recorded on the strength of a country being absent from it.
- 3The legal-document library at https://www.tms.pl/dokumenty (framework agreement, brokerage service regulations, order-execution policy, fee tables, client-classification policy) was read and publishes no restricted-jurisdiction list.
- 4The funding page at https://www.tms.pl/doladuj-konto was read and imposes no country restriction on any deposit channel.
- 5The footer risk disclaimer on https://www.tms.pl/ states that the information on the site is not directed at recipients of any particular country and is not intended for distribution to states where such distribution or use would conflict with local law. That is a category rather than a named jurisdiction, so it sets no country code.
Recorded by WIKILIX research, not published by the broker, and not a guarantee. A country listed nowhere above is not thereby accepted — check TMS's own terms before you open an account.
